TERMS OF USE

FBI Identification Record Request / Criminal Background Check

**Per FBI requirements, results can only be picked up within the United States or its territories. Please contact the FBI if you need to apply internationally.**

The U. S. Department of Justice Department Order 556-73 (“DO 556-73”) establishes rules and regulations for the subject of an FBI Identification Record (“IR”) to obtain a copy of his or her own IR for review. The FBI’s Criminal Justice Information Services (CJIS) Division Processes these requests. Accurate Biometrics, Inc. is a private business that is an FBI–approved “Channeler” for individuals requesting their own FBI Identification Record. Accurate Biometrics will provide Channeler services to you, an individual, upon receiving your payment to Accurate Biometrics of our service fees and your representation, warranty, and compliance with all of the following:

  • I am an individual located in the United States and am requesting a copy of my Identification Record only.
  • I am either a United States citizen or a non-United States citizen lawfully admitted to the United States who has permanent residence status.
  • My request for my identification record will be used only for my personal review and/or correction purposes, or to challenge the information on record, or to satisfy certain legal requirements such as a requirement for adopting a child, or to satisfy a requirement to live, work and/or travel in a foreign country, and/or other court related matters.
  • I will not use my identification record for employment and/or licensing purposes.
  • I am not permitted to capture my own fingerprints on fingerprint cards and understand the fingerprints must be obtained from a law enforcement agency or an Accurate Biometrics location, pursuant to FBI Departmental Order requirements.

Accurate Biometrics will electronically transmit your fingerprint submission with the information that you provide on the approved form to the FBI CJIS Division for a national criminal history record check, and will also receive the electronic record check result for dissemination back to you. FBI results will be mailed or emailed to you, or to your attorney with written authorization (if your Identification Record is sent to your attorney, a release statement signed by both yourself and your attorney, on your attorneys’ letterhead, must be provided with your fingerprint cards or provided to the Accurate Biometrics fingerprint technician at the time of fingerprinting).

You may also access your FBI report results using the Accurate Biometrics Customer Website. This service is provided to allow you to retrieve/save/print your FBI response within 24 hours after fingerprints are either captured using live scan (electronic fingerprint capture) or after your fingerprint cards have been received by Accurate Biometrics and electronically transmitted to the FBI.

NOTE: Per FBI requirements, Departmental Order result letters cannot be mailed to a Post Office (PO) box address. Also, applications submitted from outside the U.S. cannot be accepted or processed. Results can only be picked up within the United States or its territories. Please contact the FBI if you need to apply internationally.

If no criminal history record information is found, you will receive a “no record” response. If you have a criminal history record on file, you will receive your record. Please note, results are prohibited from being mailed to a non-US address.

PRIVACY ACT STATEMENT: The FBI’s acquisition, retention, and sharing of information submitted on this form is generally authorized under 28 USC 534 and 28 CFR 16.30-16.34. The purpose for requesting this information from you is to provide the FBI with a minimum of identifying data to permit an accurate and timely search of identity history identification records. Providing this information (including your Social Security Account Number) is voluntary; however, failure to provide the information may affect the completion of your request. The information reported on this form may be disclosed pursuant to your consent and may also be disclosed by the FBI without your consent pursuant to the Privacy Act of 1974 and all applicable routine uses.

Accurate Biometrics Use of Information and Fingerprints

I am allowing Accurate Biometrics, Inc., (and any of its agents), to capture and transmit my fingerprints for the purpose of checking my criminal history record information (“CHRI”). I authorize the release to the Agency or Authorized Recipient referenced in my submission materials of any CHRI that may exist regarding me from any agency, organization, institution, or entity having such information on file. I am aware and understand my fingerprints may be transmitted to, indefinitely retained by, and used to check the CHRI files of the Federal Bureau of Investigation (“FBI”) and applicable state criminal history depositories (e.g. the Florida Department of Law Enforcement and FBI records may be checked), including, but not limited to civil, criminal and latent fingerprint databases (“Governmental Agencies”). I understand if my photo was taken, my photo may be shared only for employment or licensing purposes and may be retained by the Governmental Agencies. I understand I have the right to challenge any information disseminated from these Governmental Agencies regarding me that may be inaccurate or incomplete pursuant to Title 28 Code of Federal Regulation 16.34 (FBI) and possibly state law.

I acknowledge reading, and agree with the terms of, the Biometrics Retention and Destruction Policy (“Policy”) document which is available at https://accuratebiometrics.com/compliance. I understand that unless obligated by customer contract or Governmental Agencies to maintain biometrics for a specified period of time, all biometrics, including my fingerprints, will be retained by Accurate Biometrics, Inc. for up to 45 days from the date of receipt, fingerprint capture or card scan date, or the “date last modified” as set forth in the Policy.

Sterling Identity Collection

Accurate Biometrics uses a third-party provider, STS SID LLC dba Sterling Identity (“Sterling Identity”) to collect your fingerprints and possibly a photograph and send these to Accurate Biometrics. Sterling Identity in turn contracts with collection locations, such as UPS Stores (“Collection Locations”) to house the equipment which collects and transmits your information. The equipment belongs to Sterling Identity and the Collection Location receives none of your personal geographic information, photograph or fingerprints but will use your name to verify your identity using your identity document.  Accurate Biometrics sends your demographic information, including your full name, date of birth, address and email address, to Sterling Identity when you complete your registration on our website. Then when you go to the Collection Location, the equipment will scan the QR Code from your completed registration and your fingerprints and photograph are collected by Sterling Identity and transmitted to Accurate Biometrics which will in turn transmit your fingerprints and demographic information to either the Florida Department of Law Enforcement or FBI. Sterling Identity will retain all your demographic information and fingerprints for up to 30 days after transmittal (in case resubmittal is needed) and then delete your fingerprints after 30 days and your other demographic information will be deleted after three years. If you provide an email address, Sterling Identity will send you a confirmation email that your fingerprints were collected and transmitted to Accurate Biometrics. Right to Report PII Breach to the FBI

If you believe that a breach of your Personally Identifiable Information (PII) has occurred as a result of our service, you have the right to report the incident to the FBI. The FBI defines PII as*: Personally Identifiable Information (PII) means information which can be used to distinguish or trace an individual’s identity, such as name, social security number, or biometric records, alone or when combined with other personal or identifying information which is linked or linkable to a specific individual, such as date and place of birth, or mother’s maiden name. The FBI defines PII breach as*: _PII Breach means the loss of control, compromise, unauthorized disclosure, unauthorized acquisition, unauthorized access or any similar term referring to situations where persons other than the authorized users, and for other than authorized purposes, have access or potential access to PII, whether physical or electronic. _Please report the PII breach as soon as possible by contacting the FBI CJIS division at (304) 625-2000 or by mail at: FBI CJIS Division Attention: Criminal History Analysis Team 1 1000 Custer Hollow Road Clarksburg, WV 26306
